Uncontested divorce in Valencia: steps and documents

A divorce by mutual consent is the quickest and most affordable way to end a marriage when both spouses agree to divorce and on its terms.

Requirements

  • At least three months must have passed since the wedding.
  • Both spouses must agree and sign a settlement agreement (convenio regulador).
  • A lawyer must assist, and it can be the same lawyer for both spouses.

Court or notary?

If there are no minor children or children with support measures, the divorce can be formalised before a notary. Otherwise it goes through the court, which checks that the agreement protects the children's interests.

Usual documents

  • ID documents of both spouses.
  • Full marriage certificate and, where applicable, the children's birth certificates.
  • Certificate of registration (empadronamiento).
  • Signed settlement agreement: custody, visiting arrangements, child support, use of the family home and division of assets.

How long does it take?

Before a notary it can be completed in a few weeks. In court it depends on the workload, but it is usually much faster than a contested divorce.
